====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 149, 341, 342, 323, 324, 325 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, the petitioner is alleged to have assaulted on the head of one Rishikesh by means of farsa due to which he sustained injury. Doctor has found the injury grievous in nature.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. There is general and omnibus allegation against this petitioner and further the allegation of firing is on Sheel Kumar Rai and not
Patna High Court CR. MISC. No.30419 of 2025(2) dt.04-07-2025 2/2 against the petitioner herein. The petitioner is in custody since 23.03.2024 and charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Samastipur in connection with Sarairanjan (Gatho) P.S.
