JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-10-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For issuance of an appropriate writ order or direction in the nature of Mandamus directing and commanding the concern respondents to revise the monthly basic pension of petitioner from Rs.25,610/- to Rs.29,550/- on pay band 4 grade pay Rs.12,000/- pay in the pay band Rs.47,100/- total last salary Rs.59,100/- from the date of retirement i.e., 01/01/2011 from the post of Chief Engineer in the above said department.

For issuance of an appropriate writ order or direction in the nature of mandamus directing commanding the concern respondents to make their payment of entire arrears of pension as well as the revised pay scale in accordance with the 6th pay commission from the due date alongwith the admissible interest likewise the other similar employees."

At the outset, the learned counsel for the RespondentState submits that the pension of the petitioner has been fixed on the basis of last pay of Rs. 52710/-, hence, the petitioner should not have any grievance. It is also submitted that the pay-scale of the petitioner was being paid as per 6th Pay Revision and the pay scale had been fixed in the Chief Engineer rank / grade i.e. PBIV in the pay band of Rs. 37400/- with grade pay of Rs. 9500/-. 3.

The learned counsel for the petitioner submits that in case, the petitioner is having any subsisting grievances, he may be granted liberty to approach the Respondent authorities. Liberty, so sought, is granted.
