In this case, the petitioners are apprehending their arrest in connection with Bibhutipur P.S. Case No. 275 of 2017 registered for offences under sections 323, 324, 307, 325, 341, 354, 379, 504/34 of the Indian Penal Code.
In the present case, the allegation has been made by the Informant against the petitioners of mercilessly assaulting and hitting the son of the Informant.
Learned counsel for the petitioners submits that not only the male member but, the female members have also been implicated in the present case though they have not participated in
Patna High Court Cr.Misc. No.36346 of 2018(2) dt.28-06-2018 2/2 any manner in the alleged offence.
Looking to the entire facts and circumstances of the case, let the petitioner nos. 1, 2 & 3, namely, Vimbla Devi, Nutan Devi and Manju Kumari @ Manju Devi, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 275 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call them for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled. However, the prayer for anticipatory bail of the petitioner nos. 4, 5 & 6 is rejected.
If they surrender before the court below and pray for bail, the court below, without being prejudiced by this order, will consider the same and pass orders on the merit of the case. (Shivaji Pandey, J) rishi/- U T
