The petitioner is in custody in connection with Adapur (Harpur) P.S. Case No. 90 of 2020, for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 19.03.2020. He submits that in the instant case total 132 litres of Nepali Kasturi wine was seized. He further submits that the petitioner is innocent and he has no concern with recovery of the seized wine.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to him. The
