28-06-2018 Heard Sri Jyoti Prakash, learned counsel for the petitioner and Sri Bisheshwar Ram, learned Addl. Public Prosecutor.
The sole petitioner, having clean antecedent, which fact has been stated in paragraph - 3 of the petition, apprehending his arrest in Dumra P.S. Case No. 427 of 2017 registered for offence under Sections 272, 273, 290 of the Indian Penal Code and Sections 30(a), 37(b)(c), 52 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner submits that in this case, three persons were apprehended on an allegation of selling and consuming toddy and thereafter, during
Patna High Court Cr.Misc. No.35929 of 2018(2) dt.28-06-2018 2/2 investigation, on vague information, petitioner has also been made accused, as if, petitioner was also involved in sale and purchase of toddy. Except aforesaid material, there is nothing against the petitioner.
In view of nature of accusation as well as the fact that petitioner is having clean antecedent, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Ram Kishun Paswan @ Kishun Paswan be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II, Sitamarhi in connection with Dumra P.S. Case No. 427 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
