The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 409/34 of the

Patna High Court CR. MISC. No.30421 of 2022(2) dt.16-11-2022 2/2 Indian Penal Code.

Allegedly, it is a case of misappropriation of government fund of Saat Nischaya Yojana of Bahadurpur Gram Panchayat. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that after lodging of the FIR, the District Panchyat Officer, Athamalgola and Technical Assistant, Athamalgola inspected the matter and found that the schemes have been implemented well. Petitioners have clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Barh, Patna in connection with Athmalgola P.S. Case No. 271 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
