Petitioners apprehend their arrest in connection with Ekma P.S.Case No. 4 of 2018 registered for the offences punishable under Sections 307, 379, 385,147, 149, 341, 323 of the Indian Penal Code and Section 27 of the Arms Act. Allegation is that one Sumit Prakash @ Ranjan Singh demanded extortion from the informant and when he refused to pay said Sumit caught hold his color and petitioner No.1 Ranjit Kumar Singh fired upon the informant which did not hit him and thereafter there is allegation that accused persons assaulted him and snatched Rs.10,000/- and gold chain from the informant. Submission of learned counsel for the petitioners is that there is no specific allegation against petitioner Nos. 2 to 4 and there is case and counter case between the parties and from the side of petitioners injuries have been received.

Having heard both sides and in the facts and circumstances, let the petitioners Nos. 2 to 4, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Saran at Chapra, in connection with Ekma P.S.Case No. 4 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.

So far petitioner No.1 is concerned, in view of allegation and criminal antecedent, his prayer for anticipatory bail is rejected. He should surrender and pray for regular bail, which shall be considered on its own merit.

With the above observation, this application is disposed of.
