JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-01-2021 After some argument, the learned counsel for the petitioner seeks not to press the present petition in order to enable the petitioner to surrender before the learned court below and pray for regular bail. However, he submits that it be indicated that after the rejection of the case of the petitioner for grant of anticipatory bail by a coordinate Bench of this Court vide order dated 02.07.2019 passed in Criminal Misc. No. 40666 of 2019, the other similarly situated co-accused person namely Saurav Kumar Gupta has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 13.02.2020 passed in Criminal Misc. No. 81548 of 2019. Having regard to the submissions made by the learned counsel for the petitioner, the present petition stands disposed

Patna High Court CR. MISC. No.28781 of 2020(3) dt.08-01-2021 2/2 off as not pressed, however, with liberty to the petitioner to surrender before the learned court of Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S. Case No. 61 of 2019 and pray for grant of regular bail.

It is needless to state that the learned court below shall take into account the order dated 13.02.2020 passed by a coordinate Bench of this Court in Criminal Misc. No. 81548 of 2019, while considering the case of the petitioner for grant of regular bail.
