29-06-2018 Heard Sri Chandra Mohan Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is lady, apprehending her arrest in Rasulpur P.S. Case No. 118 of 2017 registered for offence under Sections 30, 38 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of anticipatory bail. Learned counsel for the petitioner, at the very outset, submits that petitioner is having clean antecedent, which fact has been stated in paragraph 3 of the petition. He further submits that police, on source information, had arrested husband of the petitioner and it appears that petitioner was implicated, as if, she fled away after noticing the police and said fact was disclosed by her husband before the police. Patna High Court Cr.Misc. No.37098 of 2018(2) dt.29-06-2018 2/2 foreign liquor was recovered. He submits that husband, who was arrested, subsequently released on bail. In view of nature of accusation as well as the fact that petitioner is a lady and having clean antecedent, in the event of her arrest or surrender within a period of six weeks from today, let the petitioner namely Prabha Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 6th , Saran at Chapra in connection with Rasulpur P.S.
