JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-07-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Hisua P.S. Case No.70 of 2018 registered under Sections 147, 148, 341, 323, 307, 379, 384 and 504 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the instant application, so far as petitioner no.3 Sanoj Singh is concerned, has become infructuous in view of the fact that during the pendency of the application he has already been arrested. In that view of the matter, the application for grant of pre-arrest bail, so far as of petitioner no.3 Sanoj Singh is

Patna High Court Cr.Misc. No.35791 of 2018 (2) dt.02-07-2018 2/2 concerned, is dismissed as infructuous.

As far as petitioner nos.1 and 2, namely, Bablu Singh and Dani Singh are concerned, in view of inordinate and unexplained delay of two months in institution of the FIR, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Hisua P.S. Case No.70 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
