The petitioner seeks bail in Roushanganj (Bankey Bazar) Police Station (for brevity PS) Case No 174 of 2018 instituted for the offence punishable under Sections 386, 341, 307/34 of Indian Penal Code and Section 27 of Arms Act. The petitioner had earlier moved this Court for grant of bail in Cr Misc No 60269 of 2019 which was rejected by order dated 11.12.2019 (Annexure 1) considering the fact that, during course of investigation, cell phone and weapon used in the crime, have been recovered from possession of the petitioner.

Patna High Court CR. MISC. No.28508 of 2020(3) dt.17-02-2021 2/2 Mr Manish Kumar No II appearing for the petitioner submits that by now, the petitioner is in custody for nearly two years.

Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for bail. In view of the aforesaid circumstances, this Court, for the present, is not inclined to grant bail to the petitioner. Prayer is rejected.
