This application for grant of anticipatory bail arises out of Madhubani Town P.S. Case No. 118 of 2015, disclosing offences under Sections 304B/201/34 of the Indian Penal Code. Learned counsel appearing on behalf of the Opposite party No.2 has submitted on instructions from his client that out of some misconception and fit of rage the informant had lodged the First Information Report and he will not have any objection, if the petitioner is granted anticipatory bail.

Considering the above, this application is allowed. Let the petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on

furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with G. R. No. 747 of 2015, arising out of Madhubani Town P.S. case No. 118 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal procedure, 1973. This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
