This is an application for grant of anticipatory bail in connection with Madanpur PS case no. 180 of 2017 registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of Indian Penal Code.

The allegation against the petitioners herein and other co-accused persons is regarding assaulting the prosecution side resulting in injuries to as many as five persons. The learned counsel for the petitioners submits that there is general and omnibus allegation of assault and the petitioners herein have been falsely implicated. The petitioners

It is further submitted that as far as petitioners no. 1 and 2 are concerned, they have not assaulted any of the members of the prosecution side. As regards the petitioner no. 3, it is submitted that he is a student and has a clean antecedent. Lastly, it is contended that the present case arises out of case and counter case.

Having regard to the facts and circumstances of the case, the abovenamed petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Madanpur PS case no. 180 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
