The petitioners seek pre-arrest bail in connection with Obra P.S.Case No. 103 of 2018 registered under Sections 341, 323, 325, 307, 504 & 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the nature of injuries sustained by the informant and one another goes to suggest that the ingredients of the offences punishable under Sections 307 and 325 of the Indian Penal Code would not be attracted. It is further contended that there is admitted land dispute between the parties and in a minor
Patna High Court Cr.Misc. No.36082 of 2018 (2) dt.03-07-2018 2/2 scuffle the informant and her sister-in-law sustained only simple and superficial injuries.
Learned counsel for the State opposed the application for grant of pre-arrest bail of the petitioners. Considering the submissions made above and the injury report of the informant and one Nasiban Khatun, in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Obra P.S.Case No. 103 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
