The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B, 201 and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant was married to one Akhilesh Rai. It is stated that soon after the marriage the informant's son-in-law started making a demand of Apache motorcycle and on the informant not giving the same the six named accused persons including the petitioner herein as also one Jageshwar Rai killed the daughter of the informant and dispose of the body.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The

The allegation in the FIR is specifically against the husband of the deceased. The petitioner is in custody since 26/6/2021 and his case stands on a similar footing to that of FIR named co-accused Jageshwar Rai @ Bhagat Ji who has been enlarged on bail vide order dated 4.10.2021 passed in Cr. Misc. No. 39351 of 2021. Chargesheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case specially the grant of bail to above named co-accused Jageshwar Rai @ Bhagat Ji, the petitioner is directed to be enlarged on bail in connection with Ujiyarpur P.S. Case no. 7 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Dalsinghsarai, Samastipur.
