SONI SHRIVASTAVA ORAL ORDER 16-07-2025 As both the cases arise out of the same police station case number, with consent of parties, they have been heard together for final disposal at this stage itself.
2. Heard learned counsel for the petitioners and learned A.P.P. for the State.
3. The petitioners apprehend their arrest in a case regis-
Patna High Court CR. MISC. No.33196 of 2025(4) dt.16-07-2025 2/3 tered for the offences punishable under Sections 126 (2), 115 (2), 118 (1), 109 (1), 303 (2), 32, 351 (1) and 3 (5) of the B.N.S., 2023.
4. The allegation in the first information report is that the accused persons including these petitioners assaulted the informant by means of a weapon like stick and rod due to which the informant received serious injury.
5. It is submitted by learned counsel for the petitioners that there is general and omnibus allegations of assault against all the accused persons due to previous enmity. Further, there is case and counter case. As a matter of fact, the petitioners have lodged F.I.R. for the same occurrence on the same date, being Aurganabad Town P.S. Case No.22 of 2025, which has been annexed as Annexure-2 to the present application. It is further submitted that the injury received by petitioner, Naiyar Alam @ Raja of Cr. Misc. No.38792 of 2025 has been annexed as Annexure-3, which would show that injury is grievous in nature.
6. Learned APP for the State opposed the grant of anticipatory bail on account of the fact that the injury report of the informant indicates that he has suffered grievous injury.
7. Taking into consideration the facts and circumstances of the case as well as the fact that there is case and counter case
Patna High Court CR. MISC. No.33196 of 2025(4) dt.16-07-2025 3/3 and the petitioner, Naiyar Alam @ Raja has also sustained the grievous injury, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Aurangabad Town P.S. Case No.21 of 2025, subject to the condition as laid down under Section 482
