JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Dhankund P.S. Case no. 33 of 2017, registered under Sections 341, 147, 323, 307, 379 and 504 of the Indian Penal Code. The accusation is that on 03.07.2017, petitioner was fixing wooden bit in the field of informant, when Sunaina Devi, mother of the informant, made protest then petitioner, Shaligram Sah, Nakul Sah started to abuse his mother and he also called family members upon which Shashi Kumar, Saloura Devi, Reshmi Devi also came arm with Lathi Danda etc. and they also started to abuse. At that time, petitioner with intention to kill gave lathi blow at the head of informant Jitendra Sah, who fell down and others also caused injury to him.

Learned counsel for the petitioner submits that while

Patna High Court Cr.Misc. No.54501 of 2017 (2) dt.15-11-2017 2/2 specific allegation against petitioner is to cause injury upon informant, out of three injuries, injury No.1 lacerated wound 1 1⁄2 inch X 1⁄2 inch X skin deep frontal temporal region of right side of skull is simple in nature. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Dhankund P.S. Case No. 33 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
