Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 8(b), 18 and 29 of the NDPS Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that similarly situated co-accused had approached this Court seeking anticipatory bail by filing Cr. Misc No. 37403 of 2026 (Karu Singh @ Karu Singh Bhogta @ Karu Bhokta @ Karu Singh Bhokta vs the State of Bihar and Anr) and the same came to be allowed by an order dated 23-7-2026 after considering the case in details and on merit, thus based on parity, learned counsel for the petitioner seeks anticipatory bail.

The learned A.P.P. for the State opposes the anticipatory bail application and submits that if privilege of anticipatory bail is granted to the petitioner, the petitioner may abscond, on which the learned counsel appearing on behalf of the petitioner submits that petitioner will not abscond rather will co-operate in the investigation to prove his innocence. 5.

Considering the submission made by learned counsel appearing on behalf of the petitioner and taking into consideration the order dated 23-7-2026 in Cr. Misc No. 37403 of 2026, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Barachatti P.S. Case No. 23 of 2026, subject to the conditions as laid down under Section 482 (2) of the BNSS.

However, it is made clear that in the event, if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner, despite giving assurance to this Court, is not cooperating in the investigation, in that event, the learned trial court shall be at
