2. The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

3. The FIR has been lodged against unknown miscreants having entered into the premises of the informant and looted an amount of Rs. 2,62,931/- at gun point.

4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and his name has transpired during the course of investigation on the basis of the confessional statement of co-accused Harimohan Kumar and with regard to the said Harimohan Kumar, Annexure 2, which is order dated 03.04.2024 passed in Cr. Misc. No. 22385 of 2024

Patna High Court CR. MISC. No.32197 of 2025(2) dt.19-05-2025 2/2 has been pointed out wherein there is a direction for the petitioner to be released on bail after framing of charge. Learned counsel for the petitioner further submits that charges have now been framed in this case and the petitioner is in custody since 21.01.2025.

5. Learned APP for the State opposes the prayer for bail.

Taking into consideration that the name of the petitioner has transpired on the basis of the confessional statement of co-accused Harimohan Kumar, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Sadar P.S. Case No.127 of 2023.

7. However, the learned Court below is directed to verify whether the charges have been framed in the present case or not and if it found that charges have not been framed, the Court below shall take step for cancellation of bail bond of the petitioner.
