The petitioner apprehends her arrest in connection with Tr. No. 36 of 2018 arising out of Official Complaint Case No. 07 of 2018 for the offence punishable under Sections 383, 384, 406, 409, 420 and 120B of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be a transporter and he is not involved in purchase and sale of cane rather the sale and purchase of cane is being monitored by the concern official of Sugar
Patna High Court CR. MISC. No.26934 of 2019(2) dt.24-04-2019 2/2 factory. Moreover, nothing incriminating has been recovered from the possession of the petitioner, which is evident from the complaint itself. Hence, the petitioner may be granted the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Motihari in connection with Complaint Case No. 7 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
