1. The present petition has been filed for restoration of a writ petition bearing C.W.J.C. No. 13771 of 2023, which has stood dismissed for non-compliance of the peremptory order dated 25.06.2024.

2. The learned counsel for the petitioner has submitted that this Court by an order dated 30.04.2024 had granted time to the petitioner to file appropriate interlocutory application for amending the writ petition, however since no interlocutory application was filed, this Court had again vide order dated 25.06.2024, granted four weeks' peremptory time to comply with the earlier order of this Court dated 30.04.2024. It is

Patna High Court MJC No.1515 of 2025(2) dt.07-11-2025 2/2 submitted by the learned counsel for the petitioner that though the interlocutory application has been filed, however on account on unavoidable circumstances, the same was filed after expiry of the peremptory time granted to the petitioner to file the same, hence a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

3. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing C.W.J.C. No. 13771 of 2023 to its original file.

4. The present petition stands allowed.
