JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Phenhara P. S. Case No. 15 of 2016 registered under Sections 386, 387, 307 read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

Regard being had to the gravity of the offence and the allegation made in the FIR in which the name of the petitioner transpired in course of investigation, I am not inclined to grant him pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected.

However, in case the petitioner surrenders and seeks

Patna High Court Cr.Misc. No.36183 of 2018 (2) dt.03-07-2018 2/2 bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
