The petitioner apprehends his arrest in connection with Bajpatti P.S. Case no. 128 of 2016 registered under Sections 302/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that he is not named in the F.I.R. Petitioner's name has come during the course of investigation. Petitioner has been implicated in this case only on the basis of suspicion. Petitioner has got no criminal antecedent. Petitioner is also not named in the protest petition filed by the informant.
Learned A.P.P. has opposed the prayer for anticipatory bail of the petitioner.
Patna High Court Cr.Misc. No.134 of 2017 (3) dt.10-02-2017 2/2 Having considered facts and circumstances of the case, let above named petitioner, in the event of arrest or surrender before the learned court below within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Bajpatti P.S. Case no. 128 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
