JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2018 The petitioner is apprehending his arrest in connection with Piri Bazar P.S. Case No. 24/2018, G.R. No.265/2018, registered for offences punishable under Sections 447, 323, 307, 354(A), 379, 504, 506 and 34 of the Indian Penal Code. Allegation against the petitioner is that petitioner with other accused persons came to the house of the informant and started abusing and there is further allegation against the petitioner is that he torn the blouse of the wife of the informant. It has been submitted on behalf of the petitioner that the case and counter case has been lodged earlier to the present case and the injury though in grievous in nature, but the same is not on the vital part of the body and so far allegation of misbehaving with the wife of the informant is concerned, the same is ornamental. Heard learned APP also.
Having heard both sides, in view of the above facts, let
Patna High Court Cr.Misc. No.34630 of 2018 (3) dt.20-07-2018 2/2 the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Lakhisarai, in connection with Piri Bazar P.S. Case No. 24/2018, G.R. No.265/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) It is further made clear that the petition in no way shall threaten the informant otherwise the informant may move for cancellation of his bail bonds.
