2. This is the 2nd attempt of the petitioners. Earlier the bail application of the petitioners were rejected vide order dated 31.01.2024 passed in Cr. Misc. No. 3160 of 2024.
3. The petitioners seek regular bail in connection with
Patna High Court CR. MISC. No.30530 of 2025(4) dt.25-07-2025 2/3 Kuchaikote P.S. Case No. 215 of 2023 registered for the offence under Sections 27(b)(ii), 27(d), 28 of the Drugs and Cosmetics Act 2008 and Section 22 of the N.D.P.S. Act.
4. As per the prosecution case, 2960 litres of Phensedyl cough syrup has been recovered from the possession of the petitioner. The main accused of the case, namely, Ghanshyam has been arrested recently.
5. Learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence. He submits that the petitioners are the driver and the helper (khalashi) of the truck in question. He further submits that it has come during investigation that the petitioners were told that watermelon was to be transported and in the cartoon instead of watermelon Phensedyl cough syrup was loaded in the truck. He further submits that the trial has been delayed. The petitioners are in custody since 05.05.2023.
6. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.
7. Considering the facts and circumstances of the case, custody of the petitioners, delay in the trial and the materials which has come in their favour, this application for regular bail is allowed.

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Gopalganj, Bihar/concerned Court below in connection with Kuchaikote P.S. Case No. 215 of 2023 subject to condition that:- (i) Both the bailors shall be the family members of the petitioners.
(ii) The address of the petitioners shall be verified by the Trial Court before accepting the bail bonds of the petitioners.
(iii) The petitioners shall appear in the trial regularly either personally or through their lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bonds of the petitioners.
9. This application for regular bail stands allowed.
10. Interlocutory application, if any, is also disposed of.
