The present writ application has been filed for a direction to the respondent authorities to remove encroachment from the raiyati land of the petitioner appertaining to Khata no. 393 Plot No. 2799 situated in village Kerwana, P.S. Sursand in the district of Sitamarhi as also from the Plot No. 2797 being public road though the DCLR, Pupri (Sitamarhi) vide order dated 12.11.2013 passed in Case No. 64 of 2013-14 directed for initiation of encroachment proceeding for removal of encroachment from Plot No. 2797 being public road. Learned counsel for the petitioner now confines his

Patna High Court CWJC No.11113 of 2015 dt.16-03-2017 2/2 prayer only for disposal of the representation filed before the District Magistrate, Sitamarhi as contained in Annexure 4. Hence, the present writ application is disposed of with a direction to the District Magistrate, Sitamarhi to dispose of the representation of the petitioner as contained in Annexure 4 and pass appropriate order with regard to removal of encroachment from Plot No. 2797 if it is found to be a public road in accordance with the provisions of Bihar Public Land Encroachment Act within a stipulated period of six months from the date of receipt/production of a copy of this order.
