====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 29.11.2018 in a case for the offence registered under Sections 392 and 411 of the IPC.

The prosecution story, in brief, is that on 28.11.2018, three miscreants snatched the Mobile, Purse and Adhar Card of the informant while he was going to the house of his friend Satish at Mahendru, Patna. Thereafter, while he was returning on the same way, he identified the miscreants. On hulla, the police apprehended one miscreant named as Vikky Kumar. He disclosed other two persons as Chhotu Kumar @ Krishna and Md. Kallu (petitioner).

It has been submitted by learned counsel for the

Patna High Court CR. MISC. No.26847 of 2019(2) dt.24-04-2019 2/2 petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The name of the petitioner has come on the basis of confessional statement of co-accused. The petitioner has not been put on T.I. Parade. The recovered mobile has also not been put on T.I. Parade.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna City, in connection with Sultanganj P.S. Case No. 336 of 2018.
