The petitioners apprehend their arrest in connection with Complaint Case No. 453 of 2016 (Trial No. 1149/2017), registered for the offences alleged to have

Patna High Court Cr.Misc. No.56550 of 2017 (2) dt.14-12-2017 2/3 been committed by the petitioners under Sections 379, 420 and 34 of the Indian Penal Code.

The complainant alleged that one Ramlal Choudhary had agreed to execute a sale-deed on consideration of Rs. 5,25,000/-. Said Ramlal Choudhary received the consideration amount, but did not execute the sale-deed. The complainant alleged that the accused persons came to his shop, assaulted him and took away money from his shop.

Learned counsel for the petitioners submits that the entire allegation is false and concocted. The complainant did not give any money to said Ramlal Choudhary. The petitioners have no manner of concern with said Ramlal Choudhary. The complainant wanted to put pressure for execution of sale-deed.

Considering the facts and circumstances of the case, the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, Samastipur, in connection with Complaint
