Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is seeking bail in connection with Bakhtiyarpur P.S. Case No. 290/2019 (S.Tr.No. 178 of 2020) registered for the offences under Sections 395/397 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner has five criminal antecedents. He is in custody since 25.09.2019. Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was granted vide order dated 24.08.2021 passed in Cr. Misc. No. 6197 of 2020 but due to nondisclosure of complete antecedents in the bail application, his bail bond could not be accepted by the learned court below. It is submitted that the petitioner is accused in five cases

Patna High Court CR. MISC. No.28956 of 2022(2) dt.28-09-2022 2/2 and the same has been stated in paragraph '3' of this application. It is further submitted that in four cases, he is on bail. Learned APP for the State has accepted that earlier the petitioner had been granted bail.

Having regard to the submission that earlier the petitioner was granted bail vide order dated 24.08.2021 passed in Cr. Misc. No. 6197 of 2020 but he could not be released on bail because he had not given complete antecedents in the earlier petition, but at this stage he has disclosed five criminal antecedents and out of those five cases, he is on bail in four cases, other things remaining same, this Court directs that in case the petitioner furnishes his bail bond within a period of four weeks from today, the same shall be accepted in terms of the order dated 24.08.2021 passed in Cr. Misc. No. 6197 of 2020 by this Court.

This application stands disposed of.
