Patna High Court CR. MISC. No.29867 of 2023(2) dt.18-05-2023 2/3 The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 338, 452, 353, 332, 333 and 224 of the Indian Penal Code and under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioners submits that the petitioner no. 2 has antecedent of five cases and rest of the petitioners are persons with clean antecedent and allegation is of recovery of 1.8 liters of liquor from possession of six named apprehended accused.
Learned counsel for the petitioners submits that the petitioners were not arrested from the spot as such nothing was recovered from their conscious possession, it is next alleged that the petitioners along with other accused persons pelted stone at the police with a view to free the apprehended accused from the custody of the police. It is next submitted that the allegation of pelting stone is general and omnibus in nature. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court

No.29867 of 2023(2) dt.18-05-2023 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jaynagar P.S. Case No. 232 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
