The petitioner apprehends his arrest in Nautan P.S. case No. 183 of 2017 for the offences punishable under Section 414/34 of the Indian Penal Code and sections 11 (D), (E), (F) of the Prevention of Cruelty to Animals Act 1960. One Bolero Jeep met with an accident. The police found two cows on the Bolero Jeep which feet were tagged and one injured person was also found in the said vehicle who disclosed his name as Allauddin Nut.
The learned counsel for the petitioner submits that the petitioner is not named in the FIR. During the Course of investigation it transpired that the petitioner is the driver of Bolero Jeep bearing registration no. BR-29L-5111. It is further submitted
Patna High Court Cr.Misc. No.34577 of 2018 (2) dt.02-07-2018 2/2 that the petitioner was plying the vehicle on hire. Allaudin Nut was carrying the animal from one place to another. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Siwan in connection with Nautan P.S. case No. 183 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
