Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner, after some arguments, seeks permission to withdraw the quashing application with liberty to raise all issues at the time of framing of charge, if charge till date has not been framed, as it is submitted by learned counsel for the petitioner that the liquor was not recovered from his house but from a place outside his boundary wall. It is next submitted that if petitioner had to indulge in any illegal liquor trade, in that event he would not have kept the liquor outside his boundary and thus would have created evidence against himself.
