The petitioner seeks bail in connection with Sahebganj P.S. Case No. 369 of 2018 registered under Section 364(A) of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case on the basis of confessional statement of the co-accused. There is direct allegation against the petitioner regarding kidnapping of the informant. On perusal of the case diary, it is clear that the victim boy Vikky Kumar was recovered by the police.

Considering the facts that kidnapped boy has specifically named this petitioner regarding his kidnapping in

Patna High Court CR. MISC. No.34140 of 2019(3) dt.26-06-2019 2/2 his statement under Section 164 of the Cr.P.C., I am not incline to enlarge the petitioner on bail. Hence, the same is hereby rejected. However, liberty is given to the petitioner to move before this Court within six months.
