The petitioner apprehends his arrest in connection with Bagha Patkhauli P.S. Case No.452 of 2017 registered under Sections 5 and 6 of the Immoral Traffic (Prevention) Act, 1956. The accusation is that in course of raid of Suraj Guest House, situated at Bagaha-2 Railway Station, belonging to the petitioner, in Room No.101, one male and one female were found in suspicious condition, who disclosed their name as Vishal Chand Pandey and Nutan Dubey. In Room No.103, one male and one female were found in suspicious condition, who disclosed their name as Rohit Uraon and Lalmuni Devi.
Patna High Court Cr.Misc. No.56012 of 2017 (2) dt.04-12-2017 2/2 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Vishal Chand Pandey and Nutan Dubey, who are said to be recovered from Room No.101 of the said Guest House, were husband and wife and Vishal Chand Pandey has been released on bail by the court of the Additional Chief Judicial Magistrate-I, Bagaha, on filing of an affidavit by his mother-in-law. Similarly, Rohit Uraon and Lalmuni Devi, who are said to be recovered from Room No.103 of the said Guest House, were cousin brother and sister and Lalmuni Devi and her father have also filed an affidavit in this regard. The petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Bagha, West Champaran, in connection with Bagha Patkhauli P.S. Case No.452 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
