JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Majorganj P.S. Case No. 77 of 2016, registered under Sections 341, 323 and 307/34 of the Indian Penal Code. The accusation is that, on 10.04.2017, when the informant was sleeping at his house then he heard the sound of hot talk in between his father and petitioner due to land dispute. Thereafter informant went there and tried to pacify the dispute. At that time, two sons of Surendra Singh caught hold the informant and this petitioner caused injury at his head through iron rod. Learned counsel for the petitioner submits that, in fact, due to uprooting the onion crops occurrence took place. Further submission is that while three injuries were found on the person of

No.54903 of 2017 (2) dt.21-11-2017 the informant, i.e., sharp cutting wound, caution and abrasion pain, out of which, Injury nos. 2 and 3 were found simple in nature and the opinion about injury no. 1 was kept reserved, but that injury was also not found grievous after X-ray. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sitamarhi, in connection with Majorganj P.S. Case No. 77 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
