The petitioner apprehends his arrest in Hajipur Town P.S. case No. 73 of 2017 for the offences punishable under Section 307 and other Sections of the Indian Penal Code, Section 27 of the Arms and under Section 3⁄4 of the Explosive Substance Act. The prayer of petitioner for anticipatory bail was earlier dismissed as withdrawn vide order dated 14.07.2017 passed in Cr. Misc. No. 23777 of 2017.

The learned counsel for the petitioner submits that the leg was fractured on account of fall and the petitioner lodged the case earlier but it appears from perusal of the FIR itself that petitioner is alleged to have assaulted Sunil Kumar, maternal brother of the informant, with iron rod on his leg causing fracture

Patna High Court Cr.Misc. No.52090 of 2017 (2) dt.08-11-2017 2/2 injury and considering this fact the prayer of petitioner for anticipatory bail was earlier dismissed as withdrawn on 14.07.2017.

I do not find any fresh ground to reconsider the prayer of petitioner for anticipatory bail and, accordingly, the same is rejected.
