03-07-2018 Heard Sri Rajeev Ranjan No. II, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Jakkanpur P.S. Case No. 102 of 2018 registered for offence under Sections 30(a), 38(a), 41 and 47 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of anticipatory bail. At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. He has also drawn my attention to Annexure - 2 series to the petition to show that other two accused persons have been extended the privilege of anticipatory bail. He submits that one of the co-accused namely Suraj Chaudhary @ Suraj Kumar @ Billa, from whose house recovery of huge quantity of liquor was shown, has already been granted anticipatory bail on

Patna High Court Cr.Misc. No.36887 of 2018(2) dt.03-07-2018 2/2 07-05-20018, vide Cr. Misc. No. 27805 of 2018. It has also been argued that petitioner has been made accused only on suspicion and source information.

Be that as it may, considering the fact that petitioner is having clean antecedent as well as the fact that one of the coaccused in similar circumstance has been extended the privilege of anticipatory bail, there is no reason to refuse the same relief to the petitioner.

Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Ranu Kumar @ Raju Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Jakkanpur P.S. Case No. 102 of 2018 (Special Case No. 2009 of 2018), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
