The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 30, 30(G), 38 (i)(ii) of the Bihar Prohibition and Excise Act. As per prosecution, it is a case of English wine from the dumper truck. Accused persons fled away.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No recovery has been made from the conscious possession of the petitioner. Petitioner is neither owner nor driver/khalasi of the said dumper truck. Petitioner is in custody since 17.02.2022. Learned APP appearing for the State has opposed the prayer of regular bail.

No.29043 of 2022(3) dt.09-02-2023 2/2 Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Runnisaidpur P.S. Case No. 43/2019, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No. 1, Sitamarhi.
