JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 19-06-2017 LPA No. 519 of 2016 and LPA No. 420 of 2016 have been filed by the Institute of Banking Personnel Selection (IBPS)

Patna High Court LPA No.519 of 2016 (5) dt.19-06-2017 2/2 and the Madhya Bihar Gramin Bank, challenging the order passed by the learned writ court on 21.11.2016 in C.W.J.C. No. 18532 of 2015 whereby it was directed that respondent employee who was petitioner in the writ petition, namely Kumari Shilpy Suman be permitted to participate in the interview to be conducted by appellants.

Learned counsel appearing for the original petitioner in the writ petition, namely, Kumari Shilpy Suman points out that the said person is no more interested in participating into the selection process or working with the appellant bank as she has got selected in another bank. That being so, this appeal has become infractuous and the orders passed by the writ court could not be implemented by the appellant in view of stand taken by the original petitioner Kumari Shilpy Suman.

This appeal stands dismissed as having become infructuous due to subsequent development.
