Petitioner apprehends his arrest in Desri (Sahdei O.P.) P.S. Case No.167 of 2017 for the offence under Section 393of the I.P.C.
As per written report there is allegation that while the informant was returning to his home from Hind Chimney one motor cycle stopped his vehicle and pillion driver pointed out his revolver on him and wanted to snatch the key of motor cycle but somehow he escaped from there and informed the villagers who caught one of the miscreants Monu Kumar along with the motor cycle who disclosed that the said motor cycle
Patna High Court Cr.Misc. No.52895 of 2017 (3) dt.17-11-2017 2/3 belongs to petitioner who happens to be brother-in-law of Monu Kumar.
Counsel for the petitioner has submitted that he has no criminal antecedent. There is no allegation of any overt act against the petitioner.
In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M. II, Vaishali at Hajipur, in Desri (Sahdei O.P.) P.S. Case No.167/17 subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with further conditions: (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will automatically cancel bail bond of the petitioner and (3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution
Patna High Court Cr.Misc. No.52895 of 2017 (3) dt.17-11-2017 3/3 will be at liberty to move for cancellation of bail of the petitioner.
