JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2017 Heard learned counsel for the petitioner, learned counsel for the Opposite Party No.2 and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Begusarai Complaint Case No. 14427C of 2014 for the offence instituted under Section 498(A) of the Indian Penal Code. The allegation against the accused persons including the petitioner is of subjecting mental and physical torture upon the complainant for demand of dowry and lastly ousted her from her matrimonial home after keeping her entire ornaments. It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.55038 of 2016 (3) dt.02-03-2017 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegations made in the Complaint case are denied by the petitioner.

On behalf of the State and counsel for the complainant it has been submitted that the complainant is not ready to stay with the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today, in connection with Begusarai Complaint Case No. 14427C of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
