2. Petitioner apprehends arrest in a case registered for the offence punishable under section 380 of the Indian Penal Code.
3. As per the prosecution case, ventilator machines were stolen from A . N . Medical College & Hospital and at the time of occurrence this petitioner alongwith other co-accused were on duty .
4. It is submitted that petitioner was not a staff of medical college but he was working as an employee from an outsourcing company and he has been made accused in this case merely because on the day of occurrence, he was on duty .
Patna High Court CR. MISC. No.33671 of 2023(3) dt.09-08-2023 2/2 Moreover, nobody has seen the actual occurrence of theft, or seen the petitioner committing theft. Only on suspicion he has been made accused in this case . Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A C J M - IV, Gaya in connection with Magadh Medical College P.S. case no 66 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
