2. The petitioners apprehend arrest in connection with Muzaffarpur Rail P.S.Case No.20 of 2016 registered for an offence punishable under Sections 147, 148, 149, 435, 427, 341, 342, 323, 504 and 506 of the IPC.
3. The case has been registered against 30 to 35 unknown miscreants on the allegation that in the night of 26th March 2016 some extremists came and set ablaze the camp of a construction company. They further snatched mobile phones from the persons who were sleeping at the camp of construction company.
4. Learned counsel for the petitioners submits that the name of these petitioners and other co-accused was disclosed by two persons, namely, Gulab Chand Ram, Ajit Kumar, Dharmendra
Patna High Court Cr.Misc. No.53352 of 2017 (2) dt.10-11-2017 2/2 Ram and Manoj Ram who were arrested in course of investigation after two or three days of the occurrence. Out of them, two accused have been allowed anticipatory bail by the lower court in ABP No.264 of 2017. It further appears that both the petitioners have no criminal antecedent and allegation is omnibus against them.
5. The learned APP opposed the submissions.
6. Considering the nature of allegation facts and circumstances, prayer for anticipatory bail is allowed. Let the above named petitioners the event of their arrest or surrender before the court below within six weeks from today be released on anticipatory bail on furnishing bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur, Saran in connection with Muzaffarpur Rail P.S.Case No.20 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
