The petitioner seeks regular bail in connection with Chanan Police Station Case No. 102 of 2019, registered for the offences punishable under Section 392 of the Indian Penal Code.
The allegation, as per the First Information Report, is that two persons intercepted the informant and snatched his bag, containing Rs. 1,99,960/-.
Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and his name has transpired on the basis of the confessional statement of co-accused Md. Mustakeem, who has been granted
Patna High Court CR. MISC. No.28540 of 2020(2) dt.12-11-2020 2/3 bail by this Court, vide order passed in Criminal Misc. No. 70044 of 2019. He further submits that other co-accused persons, namely, Subodh Kumar and Chandan Sah, whose names have transpired on the basis of the confessional statement of co-accused Md. Mustakeem, have been granted bail by this Court, vide orders passed in Criminal Misc. Nos. 66922 and 81524 of 2019. He next submits that the petitioner is in custody since 28.07.2019.
After having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that similarly situated co-accused persons have been granted bail by this Court and the petitioner is in custody since 28.07.2019, I am inclined to grant bail to the petitioner. This application is, accordingly, allowed.
Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Lakhisarai, in connection with Chanan Police Station Case No. 102 of 2019.
It is further made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding
