Learned counsel for the appellants outrightly submits that the appellants had challenge the order of cognizance in Cr.Appeal (SJ) No.3071 of 2023 and vide order dated 09.10.2023 the Coordinate Bench of this Court has been pleased to stay the further proceeding of SC/ST Tr. Case No. 10 of 2023 arising out of Complaint Case No.149 of 20221 pending in the court of learned 3rd Additional Sessions Judge-cum- SC/ST Special Court, Saran so there is no apprehension of arrest

Patna High Court CR. APP (SJ) No.2142 of 2023(3) dt.13-10-2023 2/2 of the appellants, and as such, the present anticipatory bail petition has become infructuous. Accordingly, the learned counsel for the appellants seek permission to withdraw this appeal.
