JUSTICE MADHURESH PRASAD ORAL ORDER 15-01-2019 It is submitted by the learned counsel for the petitioner that in view of coming into force of the 2012 Regulation with effect from 03.04.2012, the petitioner's entitlement to compassionate appointment was to be considered as per Clause 13 of the said Regulation. Learned counsel for the petitioner therefore realizing that the issues has ever not been raised before the authorities submits that the petitioner would approach the Respondent No. 2, the District Compassionate Appointment Committee by way of representation for consideration of his claim under the 2012 Regulation.
Patna High Court CWJC No.1896 of 2015(5) dt.15-01-2019 2/2 Petitioner is at liberty to do so.
This Court is not expressing any opinion on merits of the claim.
However, in the event, such representation is filed within four weeks the District Compassionate Appointment Committee, Respondent No. 2 would be obliged to consider the same in accordance with law in the next meeting of the District Compassionate Appointment Committee, thereafter, expeditiously.
