19-04-2017 Heard Sri Swapnil Kumar Singh, learned counsel for petitioners and learned A.C. to Govt. Pleader - 3. This is the second petition for restoration of C.W.J.C. No. 11399 of 2008. The writ petition was earlier dismissed due to non-prosecution on 18-04-2013. Thereafter, on petition filed for restoration, vide M.J.C. No. 3086 of 2013, the writ petition was

Patna High Court MJC No.2676 of 2015 (2) dt.19-04-2017 2/2 directed to be restored. After restoration of the writ petition, again continuously on two dates i.e. on 16-02-2015 and 23-02-2015, there was non-appearance on behalf of petitioners and as such, the writ petition stood dismissed.

In the present restoration petition, in paragraph - 3, it has been indicated that due to non-marking of the case by the Advocate's Clerk, there was non-appearance. The ground set-forth in the petition is not sufficient to persuade the Court to restore the writ petition.
