Apprehending his arrest in connection with Bihpur P.S.Case No.484 of 2018 registered for the offence under Sections 341, 326, 307, 504, 506/34 of the Indian Penal Code and section 27 of the Arms Act the petitioner has preferred this application for grant of anticipatory bail.
It is alleged by the informant in the F.I.R. that on his refusing to give meat to the petitioner and one Malik Mandal for the reason they still owed money to him, the accused persons started to abuse and push him around. It is further alleged that on the intervention of other persons, they went away but returned after some time and fired a shot which luckily did not
Patna High Court CR. MISC. No.30773 of 2019(3) dt.24-07-2019 2/2 hit the informant or his father but hit a boy, namely, Sonu Kumar in his leg.
It is submitted by learned counsel for the petitioner that the allegations leveled against the petitioner are false, the allegation of firing is attributed on Malik Mandal and the petitioner has been implicated showing him to be the order giver. The petitioner has no connection with the co-accused and even the said Sonu Kumar is said to have sustained simple injury. He has got no criminal antecedent.
Having heard learned counsel for the parties and taking into consideration the fact that the allegation of firing is on Malik Mandal and not this petitioner, this Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., Naugachhiya, in Bihpur P.S.Case No.484 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
