The petitioners seek bail in Basnahi P. S. Case No. 11 of 2019 instituted for the offence under Section(s) 365/34 of the Indian Penal Code. Later on sections 302, 201 IPC was added.

Learned counsel for petitioners submits that petitioners are not named in the written report. The name of this petitioners has come during investigation in the further statement of informant merely on suspicion.

The dead body was recovered from bank of river which is far at a distance from from the house of Dilip Mandal. It has come during investigation that deceased has love affairs

Patna High Court CR. MISC. No.27644 of 2019(3) dt.12-07-2019 2/2 with daughter of Dilip Mandal on account of which informant has raised suspicion against these petitioners that they along with Dilip Mandal has committed the murder of son of the informant.

Petitioners are in custody since 29.1.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand)each with two sureties of the like amount each to the satisfaction of the ACJM III, Saharsa in connection with Basnahi P. S. Case No. 11 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioners.
