This is a petition for grant of anticipatory bail for offence under Section 366A/34 of the Indian Penal Code. Allegation against the petitioner is of inducement to Priya Kumari, a minor girl, to go with him. The victim girl in her statement under Section 164 of the Criminal Procedure Code has stated that she had voluntarily gone with the petitioner as she had love affairs.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bahera P.S. Case No. 205 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, Benipur, Darbhanga, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
